Downies Coins Pty Ltd ("Downies", "the Company",  "we" and "our") adheres to the Australian Privacy Principles ("APPs") contained in the Privacy Act 1988 (Cth) ("Privacy Act"). This Privacy Policy sets out the way we collect, manage and use personal information and how we handle privacy issues.

There are requirements of the APPs which we will adhere to that are not specifically described in our Privacy Policy but are deemed to be incorporated in this Privacy Policy. 

By using our website or services or transacting business with us, you agree to accept this Privacy Policy and how we collect and use your personal information. 

THE KINDS OF PERSONAL INFORMATION WE COLLECT AND HOLD

Firstly, ''personal information'' in our Privacy Policy has the same meaning as in the Privacy Act, namely it means information about a company, an identified individual or an individual who is reasonably identifiable. 

Our business involves direct contact with consumers.  When you deal with us, we will normally collect personal information about you such as your name, your contact details, and other information about your circumstances and preferences.  We also collect personal information such as billing details when needed to process an order or request. 

Generally speaking, we will collect any personal information we need in order to conduct our business and/or provide you with our services, functions and activities including the administration of our business and our marketing activities. 

We do not usually collect sensitive information, such as information about your health, racial or ethnic origin, sexual orientation, religious beliefs or affiliations. We will only collect such information if required in a specific situation and with your consent, or otherwise in accordance with the Privacy Act. 

It may not be practical for us to deal with you if you have not identified yourself or you are using a pseudonym. Where we do not have your personal information, we are not able to contact you or process your orders and requests. However, where it is practical, such as to respond to an enquiry about our products or business, we will allow individuals to remain anonymous. 

HOW WE COLLECT AND HOLD PERSONAL INFORMATION 

If it is reasonable and practicable to do so, we will collect personal information directly from you by phone, via our website, or by email (including when you call our Customer Care team or otherwise contact us with a comment or query, order one of our products, enter a competition or subscribe to one of our newsletters).

We may collect your personal information from other sources including (and not limited to) from:

  • our website;
  • video, images, text, messages, comments and submissions you upload or post on our website or social media platforms;
  • cookies and other technologies to collect information; and
  • information collected automatically from your browser and your phone when you visit our website.

When you visit our website, we may assign your computer or phone one or more cookies, to facilitate access to our website and to personalize your online experience. Our online store uses "cookies" to store information on the items you place in your shopping cart, and facilitate the online shopping process. Cookies are also used to provide a more efficient and dynamic service to regular customers. We do not use the online "cookie" data to identify individuals and associated personal information. We use the information only for internal analysis of the way customers navigate our site, and to make sure that the content is structured and informative, and easy to navigate.

Other Technologies 

We may use standard internet technology, such as web beacons and other similar technologies, to track your use of our website. We also may include web beacons in promotional e-mail messages to determine whether messages/notifications have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer our users in order to measure the overall effectiveness of our website and business. 

Web Beacons defined: Web beacons (also known as clear gifs, pixel tags or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users or to access cookies. Unlike cookies which are stored on the user's computer hard drive/phone, web beacons are embedded invisibly on the web pages or in an email. 

Web beacons may be used to deliver or communicate with cookies, to count users who have visited certain pages and to understand usage patterns. We also may receive an anonymous identification number if you come to our site from an online advertisement displayed on a third-party website. 

Downies.com has implemented and uses features that include (and is not limited to) some or all of the following: Display Advertising, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration, or Google Analytics Demographics and Interest Reporting; features of which, including Remarketing and other services, are tracked using Google Analytics. This list may change from time to time with new reporting and tools added and existing tools removed without notice. You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings.

We use remarketing with Google Analytics to advertise online, meaning third-party vendors, including Google, show our ads on sites across the Internet. Our Company and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past visits to this website.

Please use the Google Analytics opt-out browser add-on if you do not wish to participate.

Protection of your information

We will take reasonable steps to protect the personal information we collect, in both paper and electronic form, from misuse and loss as well as from unauthorized access, modification and disclosure.

Our website may contain links to other websites operated by third parties. We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website. Third party websites are responsible for informing you about their own privacy practices. Further, we are unable to guarantee and make no representations or warranties about the security or accuracy of information on third party websites and you should note that use of these websites is at your own risk. 

There are a number of places on our website where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click to see a Third Party''s site or product, you will be taken to a website or payment gateway that we do not control. The website may integrate with social media apps, sites, or media, and vice versa. This may allow the sharing of information with your friends or the public, depending on the settings you establish with the social media platform. 

These third-party websites may independently solicit and collect information, including personal information from you. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on the "privacy policy" link typically located on the webpage you are visiting. 

HOW YOU MAY ACCESS OR CORRECT THE PERSONAL INFORMATION THAT WE ARE HOLDING

To access your information or to correct information we are holding or for more information or assistance with accessing your personal information, please contact us and we will endeavour to respond to your request as soon as possible. 

We will give access in the manner requested unless it is unreasonable or impractical to do so. 

There are some circumstances in which the APPs provide that we can refuse your request for access to your personal information including if we believe the access would pose a serious threat to the life or health of any individual or if the access would have an unreasonable impact on the privacy of other individuals or if the information contains commercially sensitive information or if we can refuse the request by law. We shall inform you of our decision and reasons for any refusal of your request. 

HOW TO COMPLAIN ABOUT A BREACH OF THE APPS AND HOW WE WILL DEAL WITH SUCH A COMPLAINT

If you would like to make a complaint about our handling of your personal information or if you think we have breached the APPs or any other binding APP code that has been registered under the Privacy Act, please contact us with your complaint in writing. We will endeavour to deal with your complaint as quickly as possible. We may give a copy of your complaint to any affected party for their comment so we can properly investigate any issues. We will determine what (if any) action we should take to resolve the complaint and notify you of our decision and our reasons.

If you are not satisfied with the way we have dealt with your complaint you may file a complaint with the Office of the Australian Information Commissioner. 

OVERSEAS DISCLOSURE OF PERSONAL INFORMATION

It is expected that personal information will be released to overseas recipients as we use overseas providers to handle some of our services such as telephone services and data segmentation. We will only release information overseas in accordance with the requirements of the APPs and all Australian data protection and privacy laws.

Where we send your information to overseas service providers, we will make sure that appropriate data handling and security arrangements are in place. We have been advised by the relevant companies that they will protect such personal information in accordance with the Privacy Act and we will take all reasonable steps to ensure such compliance.

Notwithstanding the above, Privacy Principle 8.1 of the APPs, to the extent permissible by the Act, shall not apply to disclosure of your personal information. 

NO RIGHTS OF THIRD PARTIES

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of our website. 

THE PRIVACY ACT AND THE OFFICE OF THE AUSTRALIAN INFORMATION COMMISSIONER

Our Privacy Policy is subject to the Privacy Act and the APPs. Where our Privacy Policy conflicts with the Privacy Act and the APPs, the Privacy Act and the APPs shall prevail to the extent of such inconsistency.

SECURITY

As our website is linked to the internet, and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you communicate to us online. We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which you transmit to us online is transmitted at your own risk. 

CHANGES TO OUR PRIVACY POLICY

We may change this Privacy Policy from time to time and without notice. Any updated versions of this Privacy Policy will be posted on our website.

HOSTED IN AUSTRALIA

The Company's website is hosted in Australia, if you do not reside in Australia, then you, by using our website you consent to the transfer of any personal information to Australia.

SPAM ACT 2003

The Company complies with the Spam Act 2003 and best practice guidelines in relation to the contents of its commercial electronic messages. We only send e-mail advertising with each addressee''s consent, including its address and contact details in every e-mail promotion and ensures the inclusion of a functional unsubscribe facility. 

Mobile Terms of Service

The Downies Collectables mobile message service (the "Service") is operated by Downies Collectables (“Downies Collectables”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Downies Collectables' SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Downies Collectables through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Downies Collectables. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Downies or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Downies Collectables mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
